Terms of Service

GENERAL
• My terms of service will protect both you, the client, and I, the artist. Once the client has sent a commission inquiry, it is assumed that they have read through them. Any questions can be sent to [email protected].• I have the right to decline requests I am uncomfortable with (i.e., bigoted content, heavy gore, detailed animals, etc.)• Clients are not allowed to mint any commission as non-fungible tokens, otherwise known as NFTs.• Clients are not allowed to feed or submit any commission to be trained for artificial intelligence, otherwise known as AI.PAYMENT
• Payments must be maid upfront and at least 50% down payment. Commission will not proceed without the minimum down payment.• Prices are listed in United States Dollar.REVISIONS
• I will allow you to make any number of major changes during the sketching stage to ensure a final output that you are happy with.• Only minor revisions (i.e., hands, beauty marks, small accessories, etc.) will be done for free once line art or coloring has begun. Any major revisions will have an increase on the fee depending on complexity. Please communicate with me what these are so I may determine whether it is minor or major.Regarding Watercolor Commissions
• Revisions are only allowed during the sketch phase. I will take as many revisions as the paper can handle; note that too many revisions can damage the paper from too much erasure!• NO REVISIONS WHEN COLORING STARTS. Watercolor is extremely difficult to revise. Please be sure you are satisfied with the sketch before I proceed.• Colors may be limited to my available pigments.DEADLINES AND DELIVERY
• Delivery depends on the requested commission. Please check the individual details of each offered style for expected turnaround.USE
• Commissioned illustrations are for personal use only unless discussed otherwise. This includes profile pictures, social media banners, or any kind of personal enjoyment.• Monetized content refers to forms of advertising, such as posters, VTuber schedules, YouTube thumbnails, Twitch offline screens, and the like. Commissioned illustrations made for monetized use will have a 100% increase on the base price. For example, a personal use commission of $20 will be $40 for commercial use. I will not ask for royalties or any portion of sales.• Commercial use includes reselling it in any way, shape, or form such as printing to sell, downloadables, and the like. Commissioned illustrations made for commercial use will have a 200% increase on the base price. For example, a personal use commission of $20 will be $60 for commercial use. I will not ask for royalties or any portion of sales.• It is prohibited to use the commissioned illustration for non-fungible tokens (NFTs) or cryptocurrencies. The client is not allowed to feed the artwork to train generative AI either.INTELLECTUAL PROPERTY RIGHTS
• I retain all rights to the artwork. I may post it on social media and include it in my portfolio. However, if the subject in the piece contains imagery of people they know personally, then we will discuss if you are comfortable with it being publicized.• Any reuploads have to include my watermark and must be directed to my social media, @veoxylia on whichever social media platform the client decides to post it on. If I am not on that platform, please lead them back to my Twitter or Instagram. Only clients may reupload my work.• Raw files (such as PSD, Clip, or Procreate files) of illustrations will not be shared for any reason. All layered files will remain under my possession. Clients will receive PNG files of their commission.REFUNDS
• A full refund may only be honored if no work has been accomplished.• Please note that I do tend to deliver a sketch within 72 hours time. After a sketch has been approved, only partial refunds may be honored.• A partial refund may be honored before rendering phase. Depending on how far into the work I am, it may be anywhere between 20% to 60% refund. (i.e., only 20% refund if all colors have been settled, up to 60% refund if sketch has been approved.)• After the rendering phase has begun, no refunds are allowed.COMMUNICATION
• Please include reference images for your character. This includes poses, expressions, outfits, and the like. I can work off of descriptions but I may increase the price depending on the complexity of translating the descriptions into visuals.• Periodical updates will be sent throughout the process.• I usually add some effects to unify a piece. If there’s a specific undertone you would like (e.g. blue and night-like, orange for daytime, pink in romance, etc.) please let me know so I can adjust accordingly!• Please make it easy to contact you! There’s no need to reply immediately, but don’t leave me hanging.• Please be clear as possible in your commission. I will do my best to communicate with you, hopefully the same can be returned.• Please respect me as an artist.
